We do hereby release, waive, discharge and covenant not to sue Leveling The Playing Field, Inc. (hereinafter referred to as "LPF"), its directors, officers, employees, and agents from liability from any and all claims, including negligence of LPF resulting in personal injury, accidents, or illnesses (including death) and property loss arising from, but not limited to, use of equipment donated by LPF.

My organization agrees to receive completely free sporting equipment from LPF with the realization that athletic activities involve the potential for injury, which is inherent in all sports. We acknowledge that even with the most advanced and best conditioned protective equipment, injuries are still a possibility. Injuries can include, but are not limited to, head trauma, damage of joints, muscles, bones, connective tissue, and, on rare occasions, brain damage, bacterial diseases, paralysis, or death.

We the undersigned understand the dangers of practicing, playing, and participating in athletics with donated sporting equipment. We also recognize the importance of cleaning and determining the condition of equipment before it has been used by the kids. We agree to take full responsibility for the determination of a piece of equipment's safety and cleanliness.

In consideration of LPF providing completely free sporting equipment to our kids, we hereby agree to hold LPF, collectively and individually, its employees, board members, representatives and volunteers, harmless from any and all liability, actions, causes of actions, debts, claims, or demands of any kind and nature whatsoever which may arise by or in connection with equipment received by LPF. The terms hereof shall serve as a release and assumption of risk for my heirs, estate, executor, administrator, assignees, and for all members of my family and organization.

We intend this RELEASE OF LIABILITY to be effective whether or not any loss, damage, injury, or death results from the negligence of LPF or owners. I understand that negligence means failure to do an act which a reasonably careful person would do, or the doing of an act which a reasonably careful person would not do, under the same or similar circumstances to protect himself or herself, or others, from accident, injury, or death.
