Release and Waiver of Liability

This Release and Waiver of Liability (the “release”) executed on the day this form is submitted by the “Volunteer” (the person who signs their name on this online form) releases Family Promise of Greater Denver a Family Promise of Greater Denver corporation organized and existing under the laws of the State of Colorado and each of its directors, officers, employees, and agents. The Volunteer desires to provide volunteer services for Family Promise of Greater Denver and engage in activities related to serving as a volunteer.

Volunteer understands that the scope of Volunteer’s relationship with Family Promise of Greater Denver is limited to a volunteer position and that no compensation is expected in return for services provided by Volunteer; Family Promise of Greater Denver will not provide any benefits traditionally associated with employment to Volunteer; and that Volunteer is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of Volunteer’s services to Family Promise of Greater Denver.

1. Waiver and Release: I, the Volunteer, release and forever discharge and hold harmless Family Promise of Greater Denver and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from the services I provide to Family Promise of Greater Denver. I understand and acknowledge that this Release discharges Family Promise of Greater Denver from any liability or claim that I may have against Family Promise of Greater Denver with respect to bodily injury, personal injury, illness, death, or property damage that may result from the services I provide to Family Promise of Greater Denver or occurring while I am providing volunteer services.

2. Insurance: Further I understand that Family Promise of Greater Denver does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. I expressly waive any such claim for compensation or liability on the part of Family Promise of Greater Denver beyond what may be offered freely by Family Promise of Greater Denver in the event of injury or medical expenses incurred by me.

3. Medical Treatment: I hereby Release and forever discharge Family Promise of Greater Denver from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my tenure as a volunteer with Family Promise of Greater Denver.

4. Assumption of Risk: I understand that the services I provide to Family Promise of Greater Denver may include activities that may be hazardous to me including, but not limited to tasks involving inherently dangerous activities. As a volunteer, I hereby expressly assume risk of injury or harm from these activities and Release Family Promise of Greater Denver from all liability.

5. Photographic Release: I grant and convey to Family Promise of Greater Denver all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by Family Promise of Greater Denver in connection with my providing volunteer services to Family Promise of Greater Denver .

6. Contact with Clients: Volunteers should ask before hugging guests, picking up a child in the program or initiating any physical contact. Please refrain from providing financial contributions or large gifts and transporting guests in personal vehicles. Volunteer should maintain clear boundaries with program guests.

7. Other: As a volunteer, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Colorado and that this Release shall be governed by and interpreted in accordance with the laws of the State of Colorado. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.

Confidentiality and Non-Disclosure

Volunteers of the Family Promise of Greater Denver may be exposed to information which is confidential and/or privileged and proprietary in nature. It is the policy of Family Promise of Greater Denver that such information must be kept confidential both during and after volunteer service. Volunteers are expected to return materials containing privileged or confidential information at the time of separation or expiration of service.

“Privileged Information” or “Confidential Information” means any Family Promise of Greater Denver information which by its nature or content is reasonably distinguishable as confidential or proprietary. This includes but is not limited to: 1) guest information, records, images, or business; 2) donor lists; 3) intellectual property; 4) projects or programs; and 5) technical or commercial affairs. Privileged or confidential information does not include any information that was already publicly known prior to disclosure or becomes publicly know after disclosure through no action or inaction of the volunteer.

Volunteer agrees to only use privileged or confidential information for the purposes of performing services for Family Promise of Greater Denver. Volunteer will not disclosure privileged or confidential information to anyone other than authorized Family Promise of Greater Denver staff or those similarly authorized, nor will Volunteer use privileged or confidential information for their own benefit. Volunteer agrees to take reasonable measure to protect the secrecy of and avoid disclosure and unauthorized use of privileged or confidential information.

Any volunteer that divulges privileged or confidential information, whether during or after his/her term of service with Family Promise of Greater Denver, is subject to appropriate discipline, including dismissal from volunteer service. Volunteer recognizes that Family Promise of Greater Denver has a proprietary interest in any such information and/or documents and would be irreparably damaged as a result of any disclosure or dissemination thereof.

I have read, understood, and will abide by the above Volunteer Agreement.
